Pricing and Payment

Prices are subject to change without notice. Payment will be taken from your card on submitting your order on the website. The price payable by you is the price of the product displayed on the website at the time of placing your order, except in the case of obvious error. Whilst we try and ensure that all details, descriptions and prices which appear on this website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled.

All products are subject to availability while stocks last and price confirmation. We reserve the right to withdraw any products from sale without incurring liability.

When you place your order with Sell Flowers Online Ltd, this represents an offer to us to purchase a product. By placing an order, you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. Title to the products will pass to you once your order has been accepted and payment has been received in full (including any delivery charges). All prices advertised are subject to such changes. The product(s) will be at your risk from the time of delivery to you. You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.

Our Contract, Refunds and Promotional Offers

A contract between us will not be formed until we send you confirmation by e-mail that the goods which you ordered have been dispatched to you. Only those goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed. Orders for perishable items such as flowers cannot be cancelled once an order has been placed.

By placing an order with us, you agree to receive marketing e-mails from us, you can unsubscribe from the link at the bottom of each e-mail at any time, or please e-mail us, and we will do this for you.

By clicking on the ‘Check Out’ button at the end of the order process, you are consenting to be bound by our ‘terms and conditions’ contained in these Terms and Conditions and appearing anywhere on the Morning Flower website. Submitting your order is subject to our acceptance of this offer. We will send an e-mail confirmation of your order details to advise that we are processing your order via the e-mail address you provide. We will not consider ourselves bound by a contract with you until we have issued this e-mail confirmation.

If you cancel and you have already paid for the goods, you will receive a full refund only for non-perishable products. If you have returned an item for a refund, please note that refunds may take 7-10 days for the refund amount to be shown on your bank statement.

In the unlikely event of supply difficulties, Morning Flower reserves the right to substitute any product with any other type of product of equal quality and value.

In the event that we are unable to supply any Morning Flower products or any substitute to you at all, we shall notify you as soon as possible and shall reimburse your payment in full no later than thirty (30) days after the intended date of delivery.

Refunds for goods purchased under a promotional offer will be based on the terms of the promotional price. Your statutory rights are not affected. All refunds require the relevant product(s) to be returned in the original packaging.

It is important to note that flowers are perishable products and we need to be informed of any problem with your order within one business days after the delivery date to give us the best chance of successfully resolving the issue. Although, we are proud to provide the best service condition for our clients, we reserve the right to refuse a refund or replacement if there are not sufficient reasons.

In the event of quality-related issues, we kindly request you to send us a digital picture of the delivered product clearly showing the problem and indicating your full details including date of purchase and order reference number where applicable plus your full name and address and contact details.

Refunds cannot be given for flowers that have died quickly, unless we understand there to be a genuine problem. It is important that flowers are cared for correctly. Putting them by heat sources or draughts, or failing to change the water and feeding will damage them. We include instructions and flower food with all our arrangements. All flowers should generally last five days or longer, although this varies by variety. In some circumstances, flowers are sent in the bud and will not be fully open when they arrive. However, they should open once they have settled at room temperature.

It is essential that we are contacted as soon as possible regarding issues with your order or the product(s) you have ordered. We need to be informed of any problems within two (2) days of the delivery to give us the best chance of successfully resolving the issue.

In the extreme circumstances; neither us, nor the delivery service that we use, shall be liable for any failure to perform Services where such failure or delay results from any circumstances outside our reasonable control; these circumstances include but are not limited to adverse weather conditions (such as snow, flood and extreme winds), fire, explosion, accident, traffic congestion, obstruction of any private or public highway, riot, terrorism, the act of God, or industrial dispute or strike.

Substitutes & Accuracy

Please note that all our products are fresh and subject to seasonal variations, so if any flowers are not available, we reserve the right to substitute your order with flowers of equal or greater value. Likewise, we reserve the right to substitute component parts of Sell Flowers Online products and outer packaging of equal or greater value as required by the business. All items will be despatched individually unless specifically requested otherwise.

Our flower arrangements are artisan and handcrafted, so no two arrangements are ever the same. We always ensure and try to put every effort is made to match orders as closely as possible to the product photographs and descriptions. While slight variations are sometimes necessary, the concept and quality of the item ordered are always guaranteed.

UK Delivery and Conditions

Next Day Delivery – Free

We now offer a delivery tracking service, and we are unable to control the delivery process. However, we will do whatever we can to rectify any problems caused by delayed delivery.

If the order is placed by 2 pm, it will arrive on the next working day: no Sunday and Bank holidays delivery. We aim to meet these timescales, but during busy periods ( Valentines Day, Mothers Day, Easter, Christmas, etc.) deliveries may take a little longer. Therefore, during peak periods, we may need to dispatch orders in 1 or 2 working days earlier than requested delivery date so they may arrive before or on the intended date.

All Orders have sent by First Class Royal Mail unless specified differently. Please note that orders placed Saturday, Sunday, and Monday will be delivered Tuesday. Please remember that tracked24 items are not guaranteed next day delivery. Whilst we expect 90% of our products to arrive the next working day, it may take longer to arrive, particularly during peak periods.

You must ensure the item is correctly addressed (including postcode) and ordered before our latest acceptance times. You can check that you have the correct postcode by using the Royal Mail’s handy postcode finder available at www.royalmail.com/find-a-postcode. To state the obvious, we are not responsible for the accuracy of the Royal Mail’s postcode finder. It is your responsibility to ensure that the delivery address you provide for any order you place is correct.

If the recipient is not at home/office, our carrier will leave the flowers in a safe place or with a neighbour leaving a card notifying of attempted delivery. We cannot accept responsibility if the intended recipient is no longer at that address.

Our Free Delivery service is throughout the UK, except for those addresses which considered to be insecure.

Deliveries to The Scottish Highlands, Scottish Islands, the Isle of Wight, Isle of Man and Northern Ireland may take longer.

Our haulier or we cannot be held liable for any parcels that are lost or stolen as a result of any specific delivery instructions left for the carrier.

Sadly we are unable to deliver outside of the UK.

Liability AND JURISDICTION

By agreeing to these Terms and Conditions, you agree to use our website only for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations which may affect your use of the website.

You will indemnify us against all losses, liabilities, costs and expenses reasonably suffered or incurred by us, all damages awarded against us under any judgment by a court of competent jurisdiction and all settlement sums paid by us as a result of any settlement agreed by us arising out of or in connection with any breach of these conditions by you and any other liabilities arising out of your use of this website or anyone accessing the website via your online account and/or personal information.

To the full extent allowed by applicable law, in placing an order, you agree that we will not be liable to you/or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to your use of Sell Flowers Online.

Our liability in respect of any product(s) purchased through the site is strictly limited to the purchase price of the product(s). Nothing in this paragraph applies to Sell Flowers Online Ltd’s liability in respect of products sold through the Online Stores.
